A hit and run is an accident in which a vehicle collides with another vehicle, person, or other property (and damages it), and a person in the accident flees the scene. Regardless of the accident's scale, all parties involved are legally obligated to identify themselves and offer aid to anyone affected.


Which party is at fault for the accident is also irrelevant. The requirements remain the same. There are 3 steps to the process (in which the last step is conditional based on the details mentioned below).

  • Stopping to see if the accident led to any property damage or injury of one or more persons.

  • Sharing your insurance and contact information with other people involved in the accident (for example, another car driver). You must also retrieve this information from the other party(s) involved.

  • Calling 911 if a person(s) is injured or killed or if you expect the property damage to equate to over $1,500. You must wait for an emergency officer to arrive so that they can file a report.

In New York State the Penalties of a Hit & Run Can Vary Based on the Following:

  • It is considered a traffic violation if one involved party leaves the scene without sharing their insurance and contact information and there is only property damage.

  • Leaving the scene without sharing insurance and contact information when a person is injured is considered a misdemeanor. A misdemeanor is a criminal offense.

  • It is considered a Class E felony if a party leaves the scene without sharing their insurance and contact information when another party has suffered serious injuries.

  • It is considered a Class D felony if a party leaves the scene without sharing their insurance and contact information when there is a fatality.
